1.        General Provisions

1.1.         Company Responsibilities

Each Extra Service Protection (E.S.P.) Plan (“Plan”) covers the cost of repairs to selected appliances and inside lines that fail as a result of normal wear and tear as described in this agreement unless restricted by the availability of parts. When a service call is placed, the Company will promptly arrange for a qualified service technician to repair covered equipment. The Company aims to minimize total response time by continuously tracking the availability of qualified technicians. However, actual response times may be affected by extreme weather conditions.

The Company will pay for the cost of labor and parts associated with repairs covered by the Customer’s Plan. The Company guarantees that services rendered will be free from defects in workmanship or material and that all the parts used will be new, merchantable, and fit for their intended use. However, parts may be replaced with an equivalent make, type or style. The Customer is responsible for the cost of repairs that are not covered by the Plan. 

Emergency “no heat” service is provided 24 hours per day 7 days per week.

E.S.P. plans cover residential systems in individual households and are available to the owners of the property ("Customer"). Terms, conditions, and pricing are subject to change with prior notice.

2.        Terms and Conditions Applicable to all E.S.P. Plans

2.1.         Eligibility for Service

This Customer Agreement describes Terms & Conditions for all available E.S.P. Plans. Not all E.S.P. Plans are available in the areas that the Company serves.The enrollment confirmation letter indicates the individual Plans in which the Customer has enrolled. The Customer can also confirm active enrollment in individual Plans by calling the Company. 

All equipment must (a) be installed to meet local, state and federal codes, (b) satisfy manufacturer requirements for safe and proper operation, and (c) be in good working condition at the time of enrollment. 

Customers prepay for coverage.  Coverage will begin after receipt of the first payment or 15 days after enrollment (whichever is later).  Coverage is suspended at the end of the pre-paid period in case of non-payment.  The account must be current in order for the Customer to receive coverage under the Plan.  Customers will be subject to a late payment charge of $5.85 or 1.5% per month (A.P.R. 18%) for all amounts in arrears (whichever is greater).

Each E.S.P. Plan covers a single unit.  If the household has more than one unit of a particular type, (e.g., two furnaces) and only one E.S.P. Plan, the Plan will cover repairs to the first appliance for which the Customer files a claim.  E.S.P. Inside Line plans are only available for single-family households. 

The Company reserves the right to inspect equipment, piping, or electrical wiring to determine eligibility. The Company may refuse to provide service under the Plan if eligibility requirements are not met.

2.2.        Cancellation

Customers may cancel the agreement with no obligation within 30 days of enrollment and obtain a full refund minus the cost of any service calls placed during this period.

Except as provided above, customers on E.S.P. Furnace, Boiler or Air Conditioning Plans are responsible for the total annual cost of their Plans. No refunds will be provided for early cancellation, and Customers on monthly payment Plans will continue to be responsible for monthly fees for the remaining term of their Plans.

E.S.P. Inside Line, Water Heater, Heat Pump, and ApplianceCare Plans may be cancelled at any time with a 30 day notice. 

The Company may cancel the customer’s coverage with or without cause by providing notice of cancellation. Upon such cancellation, the Company shall refund all unapplied Customer payments.

To ensure uninterrupted coverage, E.S.P. Plans will renew automatically unless notification of non-renewal is received prior to the renewal date.

2.3.        Customer Responsibilities

To arrange for repairs, the Customer is required to call the Company and to provide Company representatives with safe and reasonable access to all appliances and inside lines.

2.4.        General Exclusions

Company shall not be responsible for replacement of equipment that the Company determines is beyond repair. In addition, E.S.P. Plans do not cover preventive maintenance or any work intended to help prevent a failure from occurring in the future.  However, the Company does offer some of these services for an additional fee. 

E.S.P. Plans do not cover (a) any materials, parts or labor required as a result of flooding, fire, freezing, riots, (b) damage induced by animals, abnormal conditions, customer negligence, (c) unauthorized repairs, (d) replacement, repair or maintenance of any devices, parts or controls other than those specifically covered by each plan, (e) repair or replacement of equipment due to a manufacturer recall, defect or retrofit, and (f) seasonal pilot re-lighting.

Furthermore, the Plans do not cover, and the Company will not be liable for damages incurred by the Customer, or anyone else, caused by unavoidable delays, failure to service, obsolete parts, unavailability of parts, equipment failure, weather conditions, work stoppage, strike or other circumstances beyond the Company's control.

The Plans also do not cover service involving hazardous or toxic materials, including asbestos, disposal of contaminants (e.g. refrigerants), upgrades required by federal, state or local law, or failure caused by negligence. In addition, the plans do not cover the cost of gaining access to inaccessible piping or wires or restoration costs such as plaster, drywall, or ceiling repair. In no event will the Company be responsible for special, exemplary, punitive, consequential damages, or lost profits for any reason even if advised of the possibility thereof. The Company’s total liability for incidental or consequential damage is limited to the amount paid by the Customer to the Company during the agreement year in which such a claim arose.

If any provision of the Plan shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the remaining provisions, which shall remain in full force and effect. The waiver or failure of the Company to exercise any right in connection with the Plan shall not be deemed a waiver of any further right thereof.

3.        Terms and Conditions Applicable to Individual E.S.P. Plans

3.1.     E.S.P. Furnace and Boiler

3.1.1.      Covered Parts

The Plan covers the following parts for one furnace, space heater or boiler up to a maximum of $1,500 per contract year.

Common Parts:  The Plan covers barometric damper, bearings, capacitor, circuit boards, condensate pump and drain line, coupler, draft diverter, draft inducers (internal), ignition control, (pilot/primary control, sensor/wiring), fan controls, fan assisted motor and assembly, flame sensor switch, fuses (excluding circuit breakers), gas cock, gas pressure regulator, gas valves, limit controls, pilot (standing) and safety assembly, pilot tubing, power pile generator, switches, emergency firomatic pilot, air/gas pressure, roll-out, thermocouple, thermostat (standard/regular), transformer.

Circulating Hot Water Systems (Boiler): All Common parts plus air scoops, aquastat, auto water fill valve, back flow preventor, balancing valves, burners (if available), circulator (up to 3 zones), drain-off valves, expansion tank, draining expansion tank, flow check valve, pressure gauges, purge valves, relays, aquastat/circulator, relief valve (30 lb. pop), vent valves (at boiler), zone valves and operator (3 zones).

Forced Warm Air Heating Systems (Furnace or Space Heater): All Common parts plus blower assembly, blower motor, blower pulleys, fan belt, fan controls, operating relays (fan).

3.1.2.      Exclusions and Limitations of Coverage

Exclusions include, but are not limited to: bleeding air bound systems, balancing the system, heat exchangers, radiators, or auxiliary equipment such as air ducts, air filters, electronic air cleaners, chimney maintenance or repairs, programmable thermostat, piping (water, gas, flue, etc.) vent dampers.

The Plan also does not cover fuel oil appliances, gas appliances rated at inputs of 400,000 BTU/hr or more, rooftop or hanging units, any combination ambient heat/domestic hot water heating units, draining and refilling of boiler if isolation shut off and bleeder valves have not been installed.

3.2.     E.S.P. Gas and Electric Water Heater

3.2.1.      Covered Parts

The Plan covers the following parts for one tank-based water heater up to a maximum of $350 per contract year: electric elements, gas valves, induced draft motors, ignition controls, safety controls, regulators, main burners, pilot assemblies, tubing, thermocouples, T&P relief valves, and thermostats.

3.2.2.     Exclusions and Limitations of Coverage

Exclusions include, but are not limited to: anode rods, flushing, or tank replacement.

3.3.     E.S.P. Air Conditioner or Heat Pump

3.3.1.      Central A/C Covered Parts

The Plan covers the following parts for one electric central air conditioner up to a maximum of $1,500 per contract year: bearings/shafts, belts and pulleys, blower assembly, blower motor, blower pulleys, capacitors, circuit boards, compressor, condenser motor/fans, contactor switches, delay timers, fan belt, fan controls, fan relays, fuses (internal), limit controls, motors, operating relays, schrader valves, thermostats (standard/regular), transformers.

3.3.2.      Heat Pump Covered Parts

The Plan covers one attached backup furnace (see E.S.P. Furnace for parts covered) and one Heat Pump up to a maximum of $2,000 per contract year.  This includes all parts covered by the E.S.P. A/C plan plus defrost control, defrost sensors, contactor, delay timers, high-pressure switches, low-pressure switches, fan controls, and service valves.

3.3.3.      Exclusions and Limitations of Coverage

Exclusions include, but are not limited to: condenser and evaporator coils, reversing valves, solenoid valves, balancing of system, or auxiliary equipment such as air ducts, air filters, electronic air cleaners, humidifiers, energy saving thermostat circuit breakers. The Plan also does not cover systems exceeding five tons capacity, geothermal heat pumps, split-level systems, or gas cooling equipment (including ammonia).

3.4.     E.S.P. ApplianceCare

3.4.1.      Covered Parts

The Plan covers repairs to one refrigerator, one stovetop, one oven, one dishwasher, one clothes washer, and one clothes dryer up to a maximum of $1,000 per contract year or the cash value of the appliance up to $500 per appliance at the discretion of the Company.

3.4.2.      Exclusions and Limitations of Coverage

Exclusions include, but are not limited to:  (a) hardware including cabinets, trim wheel, non-operational components that are not electrical or mechanical, (b) charges for disconnection and reinstallation of product, (c) accessories consumable items and peripheral equipment; (d) scratching, denting, rust, corrosion, scorching, (e) improper use of electrical source or replacement of fuses, (f) delivery, unpacking, removal or reinstallation of product, or (g) ice makers.

3.5.     E.S.P. Inside Line - Gas

3.5.1.      Covered Parts

The plan will cover repair or replacement of natural gas lines inside the home that have been shown to be leaking.  The Plan covers gas lines from the point of entrance into the home to the shut off valve at each appliance located within the home, flexible connectors that attach appliances to valves, and the shutoff valves themselves, up to a maximum of $4,000 per contract year.  Gas piping must be ½- to 1¼-inch pipe of a type certified by the American Gas Association, National Fuel Gas Code, or the National Fire Protection Association.  

3.5.2.      Exclusions and Limitations of Coverage

Inside Gas Line coverage only available for single-family, free-standing homes and excludes all mobile homes. Other exclusions include, but are not limited to: any exterior piping, natural gas meters including connections, regulators, underground piping, and the cost of replacing incorrectly sized piping systems. Also, the Plan will not cover the cost of moving or updating a gas line to meet code, law, ordinance, or because the repair was recommended by your gas company.

3.6.     E.S.P. Inside Line - Electric

3.6.1.      Covered Parts

The Plan covers repairs to electrical wiring inside the home up to a maximum of $4,000 per contract year.  The Plan covers standard interior copper wiring, clock or energy saving thermostat, circuit breakers, breaker panels, standard copper wiring, doorbells, standard wall outlets (including GFCI), standard wall switches and dimmers.  The Plan is only available for households with an electrical service entrance rated at or below 400 Amps.

3.6.2.      Exclusions and Limitations of Coverage

Exclusions include, but are not limited to: service entry cables or any appliances connected to the electrical system such as lighting fixtures, ceiling fans, or security systems.

3.7.     E.S.P. Inside Line - Water

3.7.1.      Covered Parts

The Plan covers leaks to interior copper or plastic water piping after the meter including: water, sewage, and heating pipes, to a maximum of $1,000 per contract year.

3.7.2.      Exclusions and Limitations of Coverage

Exclusions include, but are not limited to: galvanized piping, exterior lines, underground piping, or any appliances or fixtures connected to water lines such as: faucets, toilets, sinks, well pumps, and pool heaters or the cost of fixing incorrectly sized or clogged piping systems.

3.8.     E.S.P. Inside Line – Value Package

The Plan includes coverage for Inside Line - Gas (see section 3.5) and Inside Line - Electric (see section 3.6). 

3.9.     E.S.P. Inside Line – Value Package Plus

The Plan includes coverage for Inside Line - Gas (see section 3.5), Inside Line - Electric (see section 3.6), and Inside Line - Water (see section 3.7). 

3.10.   E.S.P. Outside Line – Water

3.10.1.    Covered Parts

The Plan covers repair or replacement of a leaking or broken single underground water supply line from the curb box (point of connection with the utility’s main line) to the Customer’s meter. Coverage is limited to $4,000 per contract year. After a water supply line is repaired or replaced, the Company will provide basic site restoration service to the affected area limited to sidewalk repairs (up to $500), filling in holes, raking and reseeding. 

3.10.2.    Exclusions and Limitations of Coverage

Exclusion include, but are not limited to: (a) movement of the meter at the time of the repair or replacement; (b) repairs of meter vaults, (c) pressure tank, pressure switch, storage tank, or any branch lines, (d) submersible pump, (e) electrical line that supplies power from the home to the submersible pump, (f) movement of buried wells to above ground, (g) well-water lines, well equipment or well-related components, (h) water systems for sprinklers, pools, hot tubs and/or other outdoor systems, (i) service lines owned by the utility or connected to a commercial facility, multi-family, mobile home or home situated on a slab, (j) replacing trees or shrubs or repairing paved and/or concrete surfaces or structures. 

3.11.   E.S.P. Outside Line – Sewer

3.11.1.    Covered Parts

The Plan covers repair or replacement of a broken single underground sewer line from the exterior foundation of your home to the utility’s main sewer line. Coverage is limited to $4,000 per contract year, plus an additional $4,000 per contract year for Public Street cutting, if necessary. After a sewer line is repaired or replaced, the Plan will provide basic site restoration service to the affected area limited to filling in holes, raking and seeding. Restoration does not include replacing trees or shrubs or repairing private paved and/or concrete surfaces or structures. 

3.11.2.    Exclusions and Limitations of Coverage

Exclusions include, but are not limited to: (a) service to any sewer line not connected to a public sewer system, including a septic system, leach field, etc.; (b) any sewer lines not owned by you or damage related to the backup of sewers and drains caused by Sewer Main Lines; (c) service to any sewer line connected to a lift station; (d) any branch line and any storm-water line connected to the sewer line or the Sewer Main Line; (e) updating and/or moving non-leaking lines to meet code, law, or ordinances or to satisfy directives of the sewer company or others; (f) removal of obstacles necessary to access the sewer line; (g) damage to your sewer line that is caused, directly or indirectly, by you, a third party, or natural disasters; (h) service lines owned by the utility or connected to a commercial facility, multi-family, mobile home or home situated on a slab. 

3.12.   E.S.P. TotalCare

The TotalCare plan includes coverage under each of the following E.S.P. plans; Furnace or Boiler, Central Air Conditioner or Heat Pump, Water Heater, ApplianceCare, Inside Line – Gas, Inside Line – Electric, and Inside Line – Water, (see individual plan coverage for details).
